ORDER:

Petitioner is a fair price shop dealer for shop No.13 situated at Sriramapuram Village, Nindra Mandal, Chittoor District. This Writ Petition is filed questioning the validity of order, dated 11.11.2011 passed by the second respondent – Revenue Divisional Officer, Chittoor, Chittoor District.

By aforesaid order, on certain allegations against the petitioner with regard to functioning of the shop, his fair price shop authorization granted is suspended pending enquiry.

This Court at the stage of admission, by order, dated 22.11.2011 granted interim suspension of the impugned order, and the said interim order continued all along.

A perusal of the material on record indicates that there are no specific allegations against the petitioner. In any event, with regard to validity of the allegations levelled against the petitioner is a matter for enquiry, but, in the absence of any specific allegation, there appears no

reason to pass the impugned order of suspension pending enquiry.

In that view of the matter, as this Court passed interim order on 22.11.2011 suspending the operation of the impugned order of suspension pending enquiry and as it is stated that the enquiry initiated against the petitioner is pending consideration, I deem it appropriate to direct the respondents to complete the enquiry on the allegations levelled against the petitioner and pass appropriate orders, as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order. It is made clear that till such time, the interim order passed by this Court on 22.11.2011 in WPMP.No.38137 of 2011 shall remain in force.

The Writ Petition is disposed of with the directions as indicated above. No order as to costs.
