Background facts, in a nutshell, are:- Shabahat Hussain Khan @ Mohammed Afsar-4th respondent claims to be the owner and pattadar of agricultural Khalsa land of a total extent of Ac.61.08 cents in Survey Nos.76 to 85/1 and 85/2, 87, 271, 276 to 284 and 295 of Vadiyavaram Village, Chegunta Mandal, Medak District, having purchased the same under a registered sale deed bearing Document No.1091 of 1356 Fasli corresponding to the year 1948 from Syed Ahmed Hussain and Syed Shammun Hussain represented by their guardian and natural father Syed Mohammed Osman for a valid consideration of Rs.6,000/-. Since he was a minor as on the date of the sale, his father took actual possession of the land covered under the sale deed. His father left Vadiyavaram village in Razakar Movement in the year 1946-47. Relationship between his father and mother came to be snapped and he remained in the custody of his mother. His father did not inform him of the land purchased in his name. After the death of his father, he came into possession of the diary maintained by his father in the year 1934-35 through his father’s friend with whom he used to reside. He had gone through the contents of the diary and came to know that his father purchased the land in his name. He obtained certified copies of the sale deeds from the Registrar Office at Hyderabad.
