WRIT PETITION No.29571 of 2011

ORDER:

The relief sought for in this Writ Petition is to declare the action of the Revenue Divisional Officer, Chittoor District (respondent No.1), in not disposing of the appeal filed by the petitioners against the order dated 24.07.2009 passed by the Inams Deputy Tahsildar, Chittoor Distrcit (respondent No.2), as illegal and arbitrary.

When the matter was listed on 05.11.2011, Learned Government Pleader for Revenue (Andhra and Rayalaseema Areas) sought time to obtain instructions. Thereafter, the matter suffered another adjournment on 30.11.2011. Today the Learned Government Pleader would submit that the petitioners have filed the appeal with a delay of 766 days; and, since no delay condonation petition was filed along with the appeal, the appeal was returned by endorsement dated 17.11.2011.

Sr i T.Babuji, Learned Counsel for the petitioners, would submit that the petitioners would re-present the appeal, along with a delay condonation petition, within two weeks from today.

In case the appeal is re-presented, along with the delay condonation petition, the first respondent shall consider the petition to condone the delay on its merits, and pass orders thereupon in accordance with law. It is made clear that in case the delay is condoned, the appeal itself shall be disposed of, in accordance with law, as expeditiously as possible preferably within three months from the date of the order passed in the delay condonation petition filed by the petitioners.

The Writ Petition is, accordingly, disposed of. However, in the circumstances, without costs.
