ORDER:

The petitioners claim to have submitted an application on 18.02.2012 to the Tahsildar, Lingasamudram Mandal, Prakasam District, respondent No.1 herein, with a request to cause survey of an extent of Acs.13.17 cents of land in various survey numbers of Lingasamudram Village and Mandal, Prakasam District. Their grievance is that no action has been taken thereon.

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue.

The Andhra Pradesh Survey and

‘Boundaries Act and the Rules made thereunder prescribe the procedure to be followed in conducting the survey of the lands. The power to survey the land is conferred on the concerned authorities. In case the applicant is found to be having interest over the land, the survey has to be conducted after issuing notice to the owners of the neighbouring lands. The application of this nature cannot be kept pending indefinitely. If there exist any reasons for not conducting the survey, the same needs to be communicated to the applicant.

Hence, the writ petition is disposed of, directing respondent No.1 to take necessary steps on the application, dated 18.02.2012, submitted by the petitioners, within a period

of four weeks from the date of receipt of a copy of this order. If there is any ground for not conducting survey of the land, respondent No.3 shall communicate the same to the petitioners. There shall be no order as to costs.

The miscellaneous petition filed in this writ petition also stands disposed of.
