7. From the above portion, it is clear that the orders passed by the Divisional Manager, Charminar Division, were cancelled only on 05.01.2012. It is pointed out that during the course of the order passed by the Regional Manager, noted supra, the petitioner reported to duty on 14.12.2011. In order words, after the petitioner has reported to duty before the Depot Manager, Falknama Depot on 14.12.2011, the earlier orders of the Divisional Manager dated 14.05.2011 were cancelled on 05.01.2012. It is obvious that the Depot Manager, Falaknama, would have solicited instructions as to whether the petitioner could be entertained to duty on or after 14.12.2011 as the said date is beyond the time limit of one week provided by the Divisional Manager in his order dated 14.05.2011, but nonetheless the fact remains that the writ petitioner has reported to duty on 14.12.2011 and thereafter only the proceedings, which are in his favour, passed by the Divisional Manager on 14.05.2011 are cancelled. No opportunity whatsoever has been provided to the petitioner before the orders are passed on 05.01.2012. Therefore, it is a case where a benefit, which has been accorded to the petitioner by the Divisional Manager on 14.05.2011, is snatched away from him without providing him any chance or opportunity. For that reason, I consider it appropriate to set aside the orders passed by the Regional Manager dated 29.03.2012 as well as the orders passed by the Divisional Manager, Charminar Division dated 05.01.2012.
