ORDER:

The relief sought for in this Writ Petition is for a direction to the respondents to absorb the petitioner in the post of watchman in the 2^nd respondent Bank with all consequential benefits.

Reliance is placed by the petitioner on an earlier order of this Court (order in W.P.No.16623 of 1988 dated 29.12.1994) whereby the respondents were directed not to terminate the services of the petitioner except as a measure of punishment or in accordance with the Rules and Regulations. The Learned Judge further observed that the respondents may consider the case of the petitioner for absorption as per the substituted Rule 73 of the Andhra Pradesh Cooperative Societies Rules.

Whie Sri P.Srinivas, Learned Counsel for the respondents, would submit that the Rules and Regulations do not enable absorption of the petitioner to the post of Watchman, he would fairly state that the order of this Court in W.P.No.16623 of 1988 dated 29.12.1994 has attained finality as no appeal was preferred thereagainst, and the respondents were required to act in accordance with, and in terms of, the said order of this Court.

There shall, therefore, be a direction to the 1^st respondent to consider the case of the petitioner for absorption, as per the substituted Rule 73 of the Rules, within a period of two months from the date of receipt of a copy of this order, and to communicate his decision in this regard to the petitioner.
