ORDER: (Per Hon’ble Sri Justice V.V.S.Rao)
The petitioner is Executive Officer of Narasannapeta Gram Panchayath. Aggrieved by the order dated 23.04.2012 of the Hon’ble Upa Lokayukta referring the complaint made by the sixth respondent to the Commissioner, Panchayat Raj & Rural Employment, for taking necessary action against the petitioner, he filed the instant writ petition.
Counsel for the petitioner invites the attention of this Court to the Memo No.16537/CPR&RE/B1/2010, dated 04.11.2011, and would submit that on a complaint made by the sixth respondent, the Commissioner dropped further action against the petitioner, and
therefore, again referring the complaint of the sixth respondent to the Commissioner is in violation of principles of natural justice and unsustainable.
After perusing the impugned order we are not able to countenance the submission. It appears, the Hon’ble Upa Lokayukta was not made aware of the Commissioner’s Memo dated 04.11.2011 referred to hereinabove. Therefore, we give liberty to the petitioner to file an application before the Hon’ble Upa Lokayukta duly enclosing the Memo dated 04.11.2011 of the Commissioner, and seek necessary redressal. This would meet the ends of justice in this case.
The Writ Petition, with the above observation, stands disposed of accordingly. The miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
