HON’BLE SRI JUSTICE K.C. BHANU WRIT PETITION No.19460 OF 2012

ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus declaring the action of the respondents in not conducting the investigation in F.I.R.No.15 of 2012 of Achanta Police Station, West Godavari District to ascertain the real culprits and the action of the respondents 1 and 2 in not taking any action as requested in the representation dated 2.4.2012 of the petitioner as illegal, arbitrary and contrary to law and consequently direct the respondents 1 and 2 to entrust the investigation of the above said crime to the officer not below the rank of a Deputy Superintendent of Police for free and fair investigation.

The learned Assistant Government Pleader for Home, on instructions, submitted that part of the investigation of the above said crime has been completed and the police filed a preliminary charge sheet for the offences under Sections 302 and 379 IPC before the concerned Court and a report will be filed after completion of the entire investigation.

4. Recording the said submission, the writ petition is disposed of directing the respondents to complete the entire investigation and file the report in the above crime before the concerned Court within a period of six weeks from the date of receipt of copy of this order.

5. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
