The petitioner with B.A., B.Ed., is statedly qualified for being appointed as Secondary Grade Teacher in District Selection Committee 1998. She appeared for Teachers Recruitment Test. She alleges that she secured 54.5 marks, but those who secured 50, 45 and 40 marks were appointed. Making these allegations she filed O.A.No.6331 of 2011 before the Andhra Pradesh Administrative Tribunal. By impugned order, the tribunal disposed of the Original Application observing that the relief sought by the petitioner cannot be acceded to by the tribunal.
This is assailed in this writ petition.
This Court heard the Counsel for the petitioner. He would submit that though the respondents filed counter affidavit stating that the last candidate got 56 marks, she obtained the information to contend that many candidates who got lessor marks than the petitioner were appointed, and this is illegal and arbitrary. The submission cannot be accepted.
The tribunal called for the records and rejected the relief observing as follows.
The applicant has disputed the above facts which lead this Tribunal to direct the respondents to produce entire selection list of Secondary Grade Teachers pertaining to DSC-98, Nellore District. Accordingly, learned G.P has placed before this Tribunal the entire merit list. On a perusal of merit list, it is seen that, no incumbent by name O.Venkataratnam is figuring in OC list. Furthermore, it is also noticed that the statement made in the counter affidavit is in tune what is inflicted in the selection list that the last selected candidate is S.Rajani Vinaya Kumar, pertaining to BC-C category, has secured (56) marks. Under such circumstances, the selection of the applicant cannot be believed as the documents prepared and maintained by the respondents speak themselves.
Having regard to the facts and circumstances of the case and for the foregoing reasons, the relief sought by the applicant cannot be conceded to by this tribunal.
The consideration by the tribunal while denying the relief to the petitioner, in our considered opinion, does not suffer from any error, and therefore, we are not inclined to interfere in the matter.
The Writ Petition is accordingly dismissed. The miscellaneous petitions, if any, shall also stand dismissed. There shall be no order as to costs.
