This appeal is directed against the order passed by the Hon’ble single Judge on 30.07.2012 in WP.No.15629 of 2012.

It is submitted by the learned senior counsel on behalf of the appellant that since the appellant is not getting any relief with regard to the supply of ‘Ghee’ in accordance with the tender, in respect of balance 86 items, the appellant’s tender though accepted by the respondent authorities, the appellant

wants to withdraw the tender,

in question, issued in their favour to settle the matter, in question.

Learned counsel appearing for the respondent – temple states that they are agreeable to accept the proposition for settlement of the matter, which has been propounded by the learned senior counsel for the appellant before us and are agreeable to float a fresh tender to settle the balance items other than the ghee and that the respondents be given liberty to float fresh tender therefor.

Subject to the aforesaid liberty and after the settlement of the accounts, all amounts whatever the appellant is entitled to should be released in favour of the appellant by the respondent authorities and the respondents are also agreeable to do the same within a period of two (2) weeks from today.

The writ appeal is accordingly disposed of. As a sequel,

the miscellaneous applications, if any, shall stand disposed of as infructuous. In the circumstances, there shall be no order as to costs.
