This petition is filed under Section 24 of the Code of Civil Procedure seeking to transfer M.V.O.P.No.230 of 2008 on the file of the M.A.C.T-cum-I Additional District Judge, Warangal to the Court of the III Additional Chief Judge, City Civil Court, Hyderabad, to be tried along with M.V.O.P.Nos.1943, 1944, 1945, 1946, 1947, 1948, 1956 and 1957 of 2009.

According to the petitioner-Insurance Company, the husband of the first respondent i.e., the father of respondents 2 and 3 died in a motor accident that occurred on 15.10.2007 near Thammadapally Village Bus Stand, Bachannapet Mandal, Warangal District and hence, respondents 1 to 3 preferred M.V.O.P.No.230 of 2008 before the M.A.C.T-cum-I Additional District Judge, Warangal, claiming compensation of Rs.7,00,000/-; that respondent No.4 preferred M.V.O.P.No.1956 of 2009, whereas respondent No.5 preferred M.V.O.P.No.1957 of 2009 before the

III Additional Chief Judge, City Civil Court, Hyderabad, claiming compensation for the injuries received by them in the same accident; that in the said accident, seven persons died and six persons sustained injuries and that M.V.O.P.Nos.1943, 1944, 1945, 1946, 1947, 1948, 1956 and 1957 of 2009, which arise out of the same accident, are also pending before III Additional Chief Judge, City Civil Court, Hyderabad. Therefore, the petitioner prayed that M.V.O.P.No.230 of 2008 may be transferred to the Court of the III Additional Chief Judge, City Civil Court, Hyderabad.

The respondents herein do not appear before this Court for raising objection to transfer. Therefore, it is presumed that they are not having any serious objection for transfer of the case as sought for by the petitioner.

Taking into consideration the facts and circumstances of the case, M.V.O.P.No.230 of 2008 is withdrawn from the file of the M.A.C.T-cum-I Additional District Judge, Warangal, and transferred to the Court of III Additional Chief Judge, City Civil Court, Hyderabad, to be tried along with M.V.O.P.Nos.1943, 1944, 1945, 1946, 1947, 1948, 1956 and 1957 of 2009.

With the above direction, the Transfer C.M.P is allowed. The miscellaneous petitions filed in this revision, if any, shall stand closed.

There shall be no order as to costs.
