The succinct facts of the prosecution case are that on 17.5.2007 one person by name B. Sridhar Rao came to the police station and lodged a written complaint stating that while he was standing in the Jogapur bus stand, he saw a police constable by name Ravinder Reddy (hereinafter referred to as ‘the deceased’) on a two wheeler and stopped him and both of them proceeded towards Marrigadda village and on the way, near Yellamma gudi, a motor cycle bearing No.AP-15AE-1003, which was driven by its rider viz., petitioner in a rash and negligent manner, hit the vehicle of the deceased, as a result of which, the deceased fell down and sustained severe head injury and also injuries near his chest and then, the deceased was shifted to Chanakya hospital, Vemulawada. On receipt of the report, a case in Crime No.28 of 2007 was registered against the petitioner for the offence punishable under Section 337 IPC. During the course of investigation, the deceased died. After receipt of P.M.E. report and after completion of investigation, a charge sheet was filed against the petitioner for the offence punishable under Section 304-IPC before the Judicial Magistrate of First Class, Vemulawada.
