ORDER:

This revision is filed by the petitioners-accused Nos.1 to 4, challenging the order dated 21.8.2012 passed by the XXIII Special Magistrate, Hyderabad in C.C.No.370 of 2012.

It is the case of the petitioners that the above C.C. is filed by the 1^st respondent-complainant against them for the offence punishable under Section 138 r/w 142 of the Negotiable Instruments Act and on 18.6.2012 the trial Court issued Bailable Warrants against them and posted the matter to 21.8.2012 and in the meantime, they entered into compromise with the complainant and paid the substantial amounts to the complainant and on the belief that the complaint may be withdrawn, they could not appear before the trial Court on 21.8.2012. But, the trial Court issued NBWs against the petitioners on 21.8.2012. Challenging the same, the petitioners-accused filed the present revision.

Heard and perused the material available on record.

Considering the facts and circumstances of the case, the petitioners are directed to appear before the trial Court and file an application under Section 70(2) Cr.P.C. to recall NBWs issued against them and on such application being filed, the trial Court is directed to dispose of the same, on the same day, on condition of each of the petitioners executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety to the satisfaction of the trial Court and on furnishing an undertaking that they shall appear before the trial Court regularly.

With the above direction, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any in this revision, shall stand closed.
