Heard Sri N.Ramachandra Rao, the learned counsel for petitioners and the learned Public Prosecutor.

2. Petitioners are A-1 to A-16 in C.C.No.1364216 of 2008 on the file of the court of Chief Metropolitan Magistrate at Visakhapatnam City (trial court). They filed this petition under Section 482 of Cr.P.C. for quashing the proceedings in the said case against them. There are other accused also.

3. The offence alleged are those punishable under Sections 143, 447 and 427 IPC and the case pertains to Crime No.66 of 2008 of III Town Police Station, Visakhapatnam. The learned counsel for the petitioners brought to my notice that petitioners have already surrendered before the trial court and they have been granted bail also.

4. The substance of the charges against the petitioners is that on 27.01.2008 before 10.30 am and 11.00 am, the petitioners and other group of accused created disturbance in unlawful assembly and committed tress pass into certain properties and also committed mischief to prevent the VUDA authorities from auctioning certain lands. Their alleged demand is that they wanted the said lands to be distributed among the weaker sections. It is not necessary to go into all those aspects now.

5. The main plea of the petitioners is that they are totally innocent and there is also no material to charge-sheet them and it

is a foisted case. It may be noted that whether there is any material in support of the charge or not is purely a question of fact and that has to be decided by the trial court. Hence, the petitioners may pursue appropriate remedies before the trial court to establish their case either at the preliminary examination stage or even during trial.

6. This criminal petition is accordingly dismissed.
