ORDER
The petitioner, who is a fair price shop dealer, is accused of offences punishable under Sections 420 and
468 IPC.
It is alleged that the petitioner without submitting registers for verification and checking in the month of November, 2011, forged signature of the Deputy Tahsildar in sales register of kerosene and coupons of RAP/TAP.
It is contended by the petitioner’s counsel that previously by order dated 24.12.2011, the petitioner was suspended from the dealership and the said order was stayed by this Court in WPMP No.2377 of 2012 in WP No.1914 of 2012 by order dated 27.1.2012 and that
to get over the said order of this Court, the Tahsildar,
Nadendla Mandal, gave false report to the police.
Subject matter of suspension order passed by the
Revenue Divisional Officer, Narasaraopet, is totally different from subject matter of this First Information Report. The suspension from dealership was on the ground of contravening certain control orders on fair
price shop dealers. The allegations of forgery are alien to the suspension order passed for violating control
orders. According to the de facto
complainant/Tahsildar, the alleged forgery of the signature of Deputy Tahsildar could be detected on 12.2.2012 when the said Deputy Tahsildar gave statement to that effect to the Tahsildar.
Having regard to the allegation of forgery of signature of the revenue official, I am of the opinion that this is not a fit case for granting anticipatory bail to the
petitioner.
In the result, the criminal petition is dismissed.
The petitioner is directed to surrender before the
Magistrate and seek regular bail thereafter.
