The petitioners 1 and 2/A.1 and A.4 in Crl.P.No.5457 of 2012 are accused of offences punishable under Sections 147, 452, 427, 395, 353, 435/149 IPC in Cr.No.127 of 2011. The petitioners 1 to 3/A.1, A.2 and A.4 in Crl.P.No.5458 of 2012 are accused of offences punishable under Sections 147, 452, 427, 395/149 IPC in Cr.No.128 of 2011. The petitioners 1 to 4/A.1, A.2, A.4 and A.5 in Crl.P.No.5459 of 2012 are accused of offences punishable under Sections 148, 454, 395 and 427/149 IPC in Cr.No.129 of 2011. The petitioners 1 and 2/A.1 and A.3 in Crl.P.No.5460 of 2012 are accused of offences punishable under Sections 148, 452, 332 and 307/149 IPC in Cr.No.130 of 2011. All the petitioners are working as Reserve Police Constables.

On 05.10.2011 the Officers deputed Police Constables for collecting waste gravel/mud from the dilapidated quarter located within the battalion compound and suddenly the quarter collapsed, due to which one Constable died and some other Constables sustained injuries. Case in Cr.No.126 of 2011 was booked on that incident for offences

under Sections 304-A, 338 and 337 IPC. After coming to know about collapse of roof of the dilapidated quarter, the Commandant rushed to that place and secured JCB to remove the debris and to rescue the Police Constable who was trapped inside the debris. The present offences in Crime Nos.127 to 130 of 2011 are reactions for the incident covered by Cr.No.126 of 2011. The said reactions turned violent resulting in vandalism in the battalion compound. It is alleged that some of the Constables in the battalion together with some family members raided the quarter of the Commandant and his office and ransacked the same, damaged properties, manhandled the Officers and their family members including snatching of valuables. Being uniformed Constables, the petitioners should have maintained restraint and discipline and should not have resorted to this kind of violent reaction on some unfortunate incident which happened inside the battalion compound. Having regard to various allegations contained in the record against the petitioners, this Court is of the opinion that these are not fit cases for granting anticipatory bail to any of the petitioners.

In the result, all the Criminal Petitions are dismissed. All

the petitioners are directed to surrender before the Magistrate and seek regular bail thereafter.
