Dharavath Chandu Naik Vs The State of a.P., through Sho., Burgampahad P.S.

The petitioner/A2 is accused of offence punishable under Section 409 IPC. He functioned as Sarpanch of Sarapaka Gram Panchayat previously. Allegations against him is that the then Panchayat Secretary/A1 gave several cheques in favour of the Sarpanch/A2 to a total amount of Rs.23,89,570/- and that the records do not show expenditure of the said amounts with reference to any vouchers. The report was given on directions of the District Collector (Panchayat Raj) after enquiry stated to have been done by Divisional Panchayat Officer, Kothagudem.

2. It is contended by the petitioner’s counsel that for all the said withdrawals of amounts there are bills and vouchers and that the so-called enquiry was made without any notice to the petitioner.

3. The petitioner is no more in office now. When Panchayat accounts and records do not show expenditure and vouchers for the said expenditure, the petitioner cannot have his own copies of

bills and vouchers. Having regard to volume of the alleged misappropriated amount, this Court is of the opinion that this is not a fit case for granting anticipatory bail to the petitioner.

4. In the result, the petition is dismissed.
