ORDER:
This Criminal Petition has been taken out under Section 482 Cr.P.C. by A-4 S.N.Nair in C.C.No.1231 of 2005 on the file of VIII Metropolitan Magistrate, Rajendranagar, Cyberabad, to quash the proceeding therein.
2. Heard learned counsel appearing for the petitioner and learned counsel appearing for the 1st respondent/complainant.
3. Learned counsel appearing for the 1st respondent/ complainant submits that the complaint has been withdrawn against the petitioner herein, and therefore, the present petition does not survive. Learned counsel placed on record the copy of the order, dated 28.11.2007, passed in C.C.No.1231 of 2005, wherein, it is indicated that the
complaint has been withdrawn against the petitioner herein and A3 Krishna Shyam.
4. Since the compliant itself is withdrawn against the petitioner herein by the 1st respondent/complainant, this Criminal Petition does not survive and accordingly, the Criminal Petition is dismissed as redundant. As a sequel to it, the interim stay granted on 05.01.2011 shall stand vacated.
