The complainant belongs to scheduled caste community and accused Nos.1 to 5 in the above Sessions Case belong to non-SC/ST caste community and they are close friends earlier. Subsequently, the complainant and another victim/eye witness Motupally Srinivas were not moving with the accused persons and hence, the accused persons bore grudge against them. While so, on 27.10.2002 at about 9 p.m., when the complainant was returning home in a car and reached the house of Mohd. Khaja Khan, A1 and A2 accosted him, abused him in the name of caste as “Eemira Madiga Lanjakodaka Neevu Urelo Leadership Chesthunnavura” and beat him with hands. Meanwhile, another victim Motupally Srinivas came and tried to rescue the complainant/victim. On that, A3 to A5 came, abused both the victims in the name of their caste and beat them with hands and caused injuries. On the complaint lodged by the complainant, a case was registered, and the S.I. of Police, Ghatkesar took up investigation. After completion of the investigation, he filed the charge sheet against the accused for the offences punishable under Section 323 IPC and Section 3(1)(x) of SC & ST (POA) Act (for short, ‘the Act’) before the Additional Judicial Magistrate of First Class, Hyderabad East and North. On committal, the learned I Additional District & Sessions Judge took up the same for disposal.
