HONOURABLE SRI JUSTICE N.RAVI SHANKAR CRIMINAL APPEAL No.1680 of 2004 JUDGMENT:
This is a complainant’s appeal from a judgment of acquittal recorded in a case relating to the offence punishable under Section 138 of the Negotiable Instruments Act i.e., cheque bouncing offence.
Counsel for the appellant is not present.
Sri G.Vijaya Saradhi, counsel appearing for the accused says that the accused died and he filed a Memo to that effect.
As this is an appeal from acquittal, it follows that on the death of the accused, the appeal shall finally abate. Accordingly, the Registry shall remove the appeal from the file as abated.
