The appellant-accused is the resident of Bodipalem of Chirala. He is living by running a brothel house. He used to sell ganja to the visitors of his house. On credible information, on 29.1.2004, the Inspector of Police, Chirala, his staff and MRO, Chirala, proceeded to the house of the appellant-accused at about 1.15 p.m and found the accused giving one packet of ganja to one male person. On seeing them, the other person skulked away from that place. When the appellant-accused tried to run away, the police detained him and found a carry bag in his hand and when they questioned, he revealed that it contained ganja. Then, the Inspector verified the contents of carry bag in the presence of MRO, Chirala and found 20 small packets of ganja of about 20 grams each and also 600 grams of loose ganja in the carry bag. Then, the Inspector after following the procedure, got registered a case in Crime No.11 of 2004 in Chirala-I Town Police Station against the appellant-accused for the offence under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act, 1985. After completion of the investigation, charge sheet was filed.
