ORDER:
Sri V.S.Raju, Learned Counsel for the applicant, would submit that, while this Court had sanctioned the scheme of amalgamation in C.P.No.211 of 2011 dated 22.03.2012, a certified copy of the order of this Court has not been filed before the Registrar of Companies and, as such, the scheme sanctioned by this Court has not come into force. Learned Counsel would submit that, as the applicant does not desire to proceed with the sanctioned scheme, an application seeking sanction of this Court not to give effect to the scheme would be unnecessary as the scheme would come into effect only on a copy of the order being filed with the Registrar of Companies, and the applicant has not filed a copy thereof. Learned Counsel would seek permission of this Court to withdraw the Company Application.
The Company Application is, accordingly, dismissed as withdrawn.
