This Contempt Case is filed alleging willful disobedience of order dated 27-12-2011 in WVMP No.4668/2011 in WPMP No.40618/2011 in W.P.No.32678/2011.

The petitioner pleaded that despite the direction given by this Court in the above mentioned order, the respondents have not considered the petitioner’s tender.

At the hearing, the learned Assistant Government Pleader for Social Welfare, placed before the Court letter No.DEEI/AEE14/4538/Medaram Jathara/2011, dated 3-1-2012 of respondent No.2, addressed to respondent No.3 wherein it is inter alia stated that in pursuance of the direction of this Court, respondent No.1 submitted the petitioner’s tender re-evaluating its technical bid duly considering both the on-line/off-line documents and that in his report dated 30-12-2011, respondent No.1 has informed that the petitioner does not satisfy certain tender conditions pertaining to execution of similar nature of work and possession of key and critical equipment etc.

From the above mentioned letter of respondent No.2, this Court is convinced that the respondents have complied with the order of this Court by considering the petitioner’s tender along with the on-line/off-line documents. If the petitioner feels aggrieved by the decision of the respondents in rejecting its tender, it shall be free to question the same by availing appropriate remedy.

Subject to the above observations, the Contempt Case is dismissed.
