JUDGMENT: (per the Hon’ble the Acting Chief Justice Sri Pinaki Chandra Ghose)
By order dated: 09.12.2011 in Review W.P.M.P. No.41115 of 2011 in W.P. No.27859 of 2011, the Hon’ble Single Judge directed the Registry to initiate suo motu contempt proceedings against Sri Seetharam Chaparla, Advocate, High Court of A.P., Hyderabad for his statement in the submissions made in the above Review WPMP, attributing ‘mala fide intention’ to the Hon’ble Court in deciding W.P.No.27859 of 2011, bringing the Court into disrepute by making such allegations, which are not withdrawn in spite of providing an opportunity to do so. Therefore, the Court prima facie satisfied, that there is no basis for such wild allegation to be made against the Hon’ble Court and directed the Registry to issue notice to Sri Seetharam Chaparla, Advocate.
Accordingly, the suo motu contempt proceedings are initiated and initially the Hon’ble Single Judge issued notice in the Contempt Case to the contemnor, and after his appearance before the Court, the matter has been directed to be posted before the Division Bench.
Accordingly, the contempt case is listed before us and the alleged contemnor appeared in person and filed his reply-affidavit. We have considered the affidavit filed by the alleged contemnor and perused the material on record.
The contemnor has specifically stated in his reply-affidavit that the Institution is the supreme and that the Judiciary should be respected in better spirit, and in order to uphold the dignity of the Hon’ble Court, he tendered apology to this Court.
Today also, the contemnor appeared in person before us and tendered unconditional apology before the Court. He submitted that whatever he has done, it is nothing but in good faith and due respect to the Hon’ble Court, and further submits that on the basis of the affidavit filed by him, his apology should be accepted by the Hon’ble Court. In view of the above, we accept the apology tendered by the alleged contemnor, Mr. Seetharam Chaparla.
The contempt case is closed. No costs.
