ORDER :

This contempt case is filed with a prayer to punish the respondents for the alleged violation of the order of this Court in W.P.No.33684 of 2011, whereunder the respondents were directed to consider the petitioner’s request for regularization of the house site in terms of G.O.Ms.No.166, dated 16.02.2008 and pass appropriate orders within six weeks.

In response to the notice ordered by this Court, the Tahsildar, Jaggaiahpet Mandal filed a counter affidavit stating that in pursuance of the order passed by this Court, the petitioner’s request was considered and an order was passed on 20.09.2012 informing the petitioner that the encroachment cannot be regularized as the scheduled land belongs to Zilla Parishad and the Chief Executive Officer, Zilla Parishad has not given consent for regularization. A copy of the said order has also been placed before this Court. In view of the said order, no further enquiry is necessary in the contempt case.

Accordingly, the Contempt Case is closed granting leave and liberty to the petitioner to challenge the order dated 20.09.2012 by working out the appropriate remedy as available under law, if so advised. No costs.
