CONTEMPT CASE No.1048 of 2010
ORDER:
This Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act, 1970, alleging that the respondents have violated the directions issued by this Court in order, dated 25.11.2009 passed in Writ Petition No.25510 of 2009, in which, the petitioner sought directions to the respondents for completion of investigation in Crime No.189 of 2009 pending on the file of I Town (Law and Order) Police Station, Kakinada.
This Court by order, dated 25.11.2009 disposed of the said Writ Petition directing the respondents to expedite the investigation, complete the same and file appropriate final report within a period of four (4) months from the date of receipt of that order.
In this Contempt Case, it is the case of the petitioner that in spite of such a direction, the respondents have not completed the investigation, and thus, violated the orders of this Court.
In the counter-affidavit filed by the respondents,
while denying various allegations of the petitioner, it is stated that after completion of investigation, final report was filed on 16.06.2010 in the Court of III Additional Judicial First Class Magistrate, Kakinada vide SR.No.2864/2010.
In view of filing of final report in the aforesaid crime, the respondents have complied the directions issued by this Court.
In that view of the matter, I do not find any merit in this Contempt Case, which is accordingly dismissed.
