ORDER:
The petitioners are aggrieved by the action of the first respondent in refusing to grant stay in CCLA’s Proceedings No.BCW2/521/2010, dated 26.11.2010.
The brief facts of the case are that the fourth respondent filed a report before the third respondent seeking cancellation of DKT pattas granted in favour of the petitioners. Third respondent passed orders dated 02.04.2010 cancelling DKT pattas and entries in ROR records. Aggrieved by the same, the petitioners preferred revision before the second respondent, which was dismissed by order dated 06.09.2010. Aggrieved by the said order, the petitioners preferred appeal before the first respondent, and the first respondent admitted the appeal, but rejected the stay petition. Aggrieved thereby, the present writ petition is filed.
Learned counsel for the petitioners submits that the petitioners’ sugar crop is standing on the lands and that irreparable loss would be caused to them, in case stay is not granted.
After hearing the learned counsel for the petitioners, the writ petition is disposed of with a direction to the first respondent to dispose of the appeal filed by the petitioners, on merits, expeditiously, preferably within a period of one month from the date of receipt of a certified copy of this order. There shall be no order as to costs.
