THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN WRIT PETITION No. 7805 of 2001
ORDER:
The relief sought for in this Writ Petition is to declare the inaction of respondent Nos.5 to 7, in allowing the petitioner to discharge his duties as Vice-Principal-cum-Lecturer, and to declare the inaction of respondent Nos.1 to 4, in taking action against respondent Nos.5 to 7 in response to the petitioner’s representations dated 20.03.2001 and 29.03.2001, as illegal and arbitrary. A consequential direction is sought to direct respondent Nos.5 to 7 to continue the petitioner in the service as VicePrincipal-cum-Lecturer.
While fairly submitting that the M.R.R. Memorial Degree & P.G. College, Nayanagar, Kodad is a private college, and not an instrumentality of the State under Article 12 of the Constitution of India, Sri V. Ravi Kiran Rao, Learned Counsel for the petitioner, would draw attention of this Court to the counter-affidavit filed on behalf of respondent Nos.5 and 6, in WPMP.No.4153 of 2003 in W.P.No.7805 of 2001, wherein it is stated that the College had informed the petitioner, through its letter dated 03.12.2001, to come and join duty but, since the petitioner was engaged in a more lucrative business of transporting Morrum to K.C.P. Limited, Macharla, he did not join duty. Learned Counsel for the petitioner would submit that, in view of this averment, the petitioner may be permitted to pursue other remedies as available to him in law.
Leaving it open to the petitioner to do so, and as no relief can be granted, the Writ Petition is dismissed. However, in the circumstances, without costs.
