B. Savitha Vs The Chief Rationing Officer

This writ petition is filed for a mandamus to declare the action of the respondents in not supplying the essential commodities to the petitioner’s fair price shop No.823 situated at Venkatagiri, Yousufguda, Hyderabad as illegal and arbitrary.

It is the pleaded case of the petitioner that her fair price shop was inspected by the officials of the civil supplies department on 15.03.2011 and the stocks were seized on account of certain irregularities. Her further pleaded case is that even though her authorization has not been suspended or varied in any manner so far, respondent No.3 has stopped supplies to her for distribution to the cardholders.

At the hearing, the learned Assistant Government Pleader for Civil Supplies, on instructions, stated that so far the petitioner’s authorization has not been suspended. In my opinion, so long as the petitioner’s

authorization subsists, she cannot be prevented from distributing the essential commodities to the cardholders under her authorization. Therefore, respondent No.3 is directed to continue the supplies to the petitioner for distribution, so long as her authorization remains intact.

Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the writ petition, W.P.M.P.No.8795 of 2011 filed by the petitioner for interim relief is disposed of as infructuous.
