Heard the learned counsel appearing for the petitioner.
This writ petition is filed seeking issuance of writ of mandamus declaring the action of the first respondent in rejecting the tenders filed by the petitioner pursuant to the short tender notice in ROC No.525/2008/F2, dated 20.03.2009 relating to package No.54 as illegal, arbitrary and unconstitutional and direct the respondents to accept the tender filed by the petitioner and issue work order in respect of package No.54.
The counsel for the respondents submitted that the period has been already elapsed, and no cause survives in the writ petition, hence the writ petition may be dismissed as it became infructuos.
Recording the said submission, the writ petition is dismissed as infructuous. There shall be no order as to costs.
