ORDER:
This Writ Petition is filed seeking a direction to respondent No.4 to receive, register and release the documents pertaining to Ac.0.50 cents in Sy.No.82/1 of Narayanareddipalli Village, Sambepalle Mandal, Kadapa District.
The petitioner averred that originally one Gurram Venkatesh was the absolute owner and possessor of land admeasuring Ac.1.72 cents, in Sy.No.82/1 of Narayanareddipalli Village, Sambepalle Mandal, Kadapa District, and he inturn sold it Sri Peddanna and another, under document No.369/35 dated 24.06.1935, which was later purchased by the third parties. Ultimately, the petitioner purchased the land admeasuring Ac.0.50 cents under document No.5828/98 dated 12.09.2008, and since then he is in possession and enjoyment of the said land. When the petitioner sought to sell the property and approached respondent No.4, the latter declined to receive the same on the ground that the said land is a government land. Feeling aggrieved by the said action, the petitioner filed the present Writ Petition.
Learned Counsel for the petitioner submits that since the land in question is the patta land and the petitioner’s predecessors were in title since 1935, respondent No.4 cannot decline to register the land.
Learned Assistant Government Pleader for Revenue submits that the petitioner never submitted the documents for registration before respondent No.4.
Having heard the learned Counsel for the parties, the Writ Petition is disposed of with a direction to respondent No.4 to
entertain the documents presented by the petitioner and process the same for registration in accordance with law. No order as to costs.
