Heard the learned counsel for the petitioner and Sri Nandigama Krishna Rao, the learned standing counsel for the respondents.

This writ petition is filed by the petitioner seeking for the issuance of writ of mandamus, declaring the action of the respondent authorities in not disposing of the representations dated 11-8-2011 even after the Lok Adalath Decree in OS.No. 178 of 2008 dated 29-9-2010 as illegal, arbitrary and consequently to direct the respondent authorities to dispose of the representation dated 11-8-2011 for providing job to the petitioner on compassionate grounds.

3. The case of the petitioner is that his father was an employee in the respondent-company, he worked as Trammer in MK-4 Incline of Singareni Collieries Company Limited vide EC.No. 2526379. The father of the petitioner expired on 11-5-2008. After the death of his father, he claimed the terminal benefits by denying the right of his sisters by name Smt. Neelam Pushpalatha wife of Rambabu and Smt. Enugu Rama Devi wife of Chandraiah, since they were married at that point of time. It is stated

that the sisters of the petitioner filed OS.No.178 of 2008 on the file of the Court of Junior Civil Judge, Manchriyal seeking declaration that each of them are entitled for 1/3^rd share in the death benefits of the deceased father of the petitioner. It is stated that the matter was adjudicated in Lok Adalath and the Lok Adalath passed decree dated 29-9-2010 in OS.No. 178 of 2008 whereunder it was agreed that the plaintiffs in the suit i.e., sisters of the petitioner herein are entitled to amounts towards CMPF, GIS, FBIS (Accumulations) from terminal benefits of Late Sri Mudam Venkati and this petitioner did not have any share and the petitioner is entitled to amounts towards monthly pension (CMPS), Gratuity, FBIS (death claim), Matching grant and further dependent job facility or its monetary benefits.

While things stood thus, the petitioner made a representation dated 11-8-2011 to the Chief General Manager, Singareni Collieries Company Limited, Mandamarri Area, Adilabad district, seeking appointment on compassionate grounds and the said representation is pending on the file of Chief General Manager, who is the first respondent herein. Therefore, the present writ petition is filed.

Having regard to the facts and circumstances, this writ petition can be disposed of directing the first respondent to consider and dispose of the representation dated 11-8-2011 filed by the petitioner seeking for compassionate appointment on account of the death of his father in harness, who worked as Trammer in MK-4 Incline of Singareni Collieries Company Limited vide EC.No.2526379, and pass appropriate orders in

accordance with law, preferably within a period of six weeks from the date

of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of at the

stage of admission. No costs.
