This writ petition has been filed by Akberuddin Owaisi seeking Mandamus declaring the inaction of the first respondent in considering the representation complaining illegal constructions on property of Masjid-e-Quboor, situated at Panjagutta, Ameerpet, Hyderabad as illegal and arbitrary.

The petitioner claims to be a member of the Legislative Assembly. The Wakf institution known as Masjid-e-Quboor is situated at Panjagutta, Ameerpet, Hyderabad and it is a registered Wakf. The Commissioner of Wakf appointed by the State Government has also surveyed the institution and declared that the institution is in an extent of 8162 square yards. According to the petitioner, some un-social elements encroached upon certain portion of the land to an extent of 1800 square yards and they are carrying on construction. He submitted a representation to the A.P. State Wakf Board-first respondent on 15-11-2011 to prevent the illegal construction. There being no action on the part of the first respondent, he approached this Court invoking the jurisdiction under Article 226 of the Constitution of India seeking the relief stated supra.

Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the first respondent and the learned Standing Counsel appearing for respondent Nos.2 to 4.

The limited grievance of the petitioner is non-consideration of his representation dated 15-11-2011 whereunder he complained illegal constructions that are being

carried on the property owned by Masjid-e-Quboor. In that view of the matter, the writ petition is disposed of directing the first respondent to consider the representation of the petitioner dated 15-11-2011 and take appropriate action after putting on notice to the affected parties. No costs.
