ORDER:
The petitioner is working as Clerk-cum-Cashier in Sapthagiri Grameena Bank, the 1st respondent herein. Steps were initiated by the 1st respondent to select and appoint Officers in Junior Management Scale-I. Cashier is one of the feeder category posts. There are two channels for the post of Junior Management Scale-I. The first is on the basis of merit, for which any eligible candidate, irrespective of the seniority, can compete and the selection will be purely on the basis of the merit. The second is in the ordinary channel, in which the appointment will be on the basis of senioritycum-merit. The zone of consideration is 1:3. In both the categories, 9 vacancies, each, existed. The grievance of the petitioner is that, though he appeared in the examination and secured fairly good marks, he was not selected to the post.
Heard learned counsel for the petitioner.
At the stage of admission, respondents were directed to find out the marks obtained by the petitioner, on the one hand, and the last selected candidate, on the other. It is represented that the last candidate selected under merit category secured 74 marks, whereas the petitioner secured 70.83 marks. So far as the normal channel is concerned, it is stated that 27 candidates were considered in a ratio of 1:3 and the petitioner was not considered,
since he figures at serial No.40, in the seniority list.
The petitioner was not selected under the merit category, since he secured only 70.83 marks, as against 74 marks secured by the last candidate. No exception can be taken to the action of the respondents in not selecting the petitioner under that category. So far as the ordinary channel is concerned, the petitioner figured at serial No.40 in the seniority list, whereas the zone of consideration for the 9 vacancies is up to the serial No.27. Either way, the petitioner cannot be said to have suffered any detriment.
