On the other hand, the respondents have filed counter affidavit rebutting the averments made in the affidavit filed in support of the Writ Petition. It is stated in the counter affidavit filed on behalf of the respondents that an extent of Ac.1.75 cents of agricultural land in RS.No. 566/3A was declared as LC land and the declarant surrendered the said land to the Government and the Government issued pattas to the weaker section people during the year 1983. The father of the petitioners was found in occupation of the said land, in contravention of Sub Section (2) of Section 3 of the Act. Hence, a notice in Form-II under Rule 3 of the Rules was issued on 29.05.2007 to the transferee-father of the petitioners, asking him to show cause as to why he should not be evicted from the aforementioned assigned land. It is stated that Notice in Form-I was also issued to the original assignees. It is stated that both the original assignees and the transferee-father of the petitioners did not submit any explanation in reply to the said notices in the stipulated time mentioned in the said notices. Thereafter, resumption order vide RC.A.No.191 of 2007, dated 16.3.2008 was passed, resuming the land to Government and possession was also taken on 20.07.2009.Therefter, the said land was proposed for distribution to eligible beneficiaries and A.1 notice was also published on 2.2.2010 calling for objections, if any, on the proposed beneficiaries selected for assignment of the said land.
