ORDER :
In this writ petition, the petitioner seeks declaration, declaring the action of respondents in not furnishing his 2nd B.A. degree certificate with mathematics, economics and politics as optionals, as illegal and arbitrary, and he also questions the non-consideration of his representation, dated 22.07.2009.
In the affidavit filed in support of the writ petition, it is stated that the petitioner has passed his S.S.C. in March 1981 from Zilla Parishad High School, Balajipeta and studied Intermediate in Parvathipuram. Later, he has completed his degree course in B.A. as a private candidate with politics, public administration and sociology, during the academic years 1986-1989 from the School of Distance Education, Andhra University.
In this writ petition, it is the grievance of the petitioner that again, he obtained 2nd degree i.e. B.A. degree with mathematics, economics and politics as optional subjects, during the academic years 2001-2004 and passed the same in the year 2006. It is the grievance of the petitioner that though he has passed in all the subjects and the University has furnished the marks lists, the degree certificate is not being furnished to him.
Though the writ petition is of 2009, no counter affidavit is filed by the respondents. But, on instructions, it is submitted by Sri P.B.Vijaya Kumar, learned Standing Counsel appearing for the Andhra University that as certain particulars are not available in the University with regard to
passing of all the subjects by the petitioner and for want of his registration number, the petitioner’s case is not being considered.
As no decision has been taken so far on the earlier representation filed by the petitioner, and in view of the submissions made by the learned counsel on either side, I deem it appropriate to dispose of the writ petition, permitting the petitioner to make a fresh representation within a period of four weeks from today, giving the details of his registration number and also furnishing the copies of all marks lists, for issuance of degree certificate. If any such application is filed along with necessary particulars, the 1st respondentUniversity shall consider the same and take appropriate steps as expeditiously as possible, preferably within a period of six weeks from the date of receipt of said application.
Subject to above directions, this writ petition is disposed
of. No order as to costs.
