ORDER:
The petitioner was appointed as an Anganwadi Helper through proceedings dated 23.06.2007 for Venugopal Nagar III Anganwadi Center. She states that she discharged her duties regularly till she suffered injuries in an accident, followed by jaundice. She states that she was issued an interview call letter for that very post and thinking that the same would be in consideration of her representation for permitting her to rejoin duties, she had attended the interview. Her grievance is that the respondents did not permit her to join duties. She challenged the action of the respondents.
The third respondent filed a counter-affidavit. It is stated that the petitioner absconded from duties and taking the same into account, memos were also issued. It is ultimately stated that the services of the petitioner were terminated through proceedings dated 07.01.2011. It is further stated that steps are initiated for filling the vacant post and that the case of the petitioner will also be considered.
Heard the learned counsel for the petitioner and the learned Government Pleader for Women Development and Child Welfare appearing for the respondents.
The petitioner was under the impression that her services remained intact and the interview was only for the purpose of testing her eligibility to rejoin the duties. The fact, however, remains that the services of the petitioner were terminated through proceedings dated 07.01.2011. Unless the said proceedings are challenged, the petitioner cannot get any relief.
Hence, the Writ Petition is dismissed leaving it open to the
petitioner to pursue her remedies vis-à-vis the proceedings dated 07.01.2011. There shall be no order as to costs.
