HONOURABLE SRI JUSTICE NOOTY RAMAMOHANA RAO W.P.No.15980 of 2011

ORDER:

It is shown from the communication dated 14.03.2011 sent up by the Tahsildar, Nandyal, Kurnool District to the Sub Registrar, Nandyal that certain lands, survey numbers and extents of which have been mentioned in the said letter, are proposed for acquisition for providing house sites to the poor and the said proposals are receiving consideration of the District Collector, Kurnool. The petitioners are apprehending that they are liable to be dispossessed even without the proposed acquisition proceedings materialized and hence approached this Court.

It is abundantly made clear to the respondents that if the petitioners are in possession of any private patta land, they shall not dispossess them without acquiring the said land. If the petitioners are in possession of any assigned land, they shall not be dispossessed without resuming possession of the said land in accordance with law.

Learned Government Pleader for Revenue suggests that with this order, the writ petition itself can be disposed of.

Hence, the respondents are directed not to evict the petitioners from out of the lands in their possession either without finalizing the proposed acquisition proceedings or without following due process of law before lands are resumed possession of from the petitioners.

This writ petition stands disposed of at the stage of admission. No costs.
