Petitioner, who is a dealer for distribution of cooking gas, filed this writ petition questioning the telegraphic communication sent by the second respondent – Project Director, District Rural Development Agency, Kadapa, on 06.01.2004.

The State Government has issued guidelines in G.O.Ms.No.65, dated 22.12.2001, for distribution of LP Gas connections to the Below Poverty Line Women, sanctioned by the Government of India under a scheme called “Deepam”. As per the said Scheme, basing on the representation of the petitioner, the first respondent - Joint Collector, Kadapa, issued proceedings, dated 24.07.2003 in Rc.No.APO/197/Deepam, detaching the connections in Chinnamandam, Ramapuram, Rayachoti, Sambepalli, T.Sundupalli and Veeraballi Mandals from Sri Vinayaka Gas Agency, Rayachoti and attaching the same to the petitioner agency. Further proceedings were also issued allocating certain number of connections. But, subsequently, on 06.01.2004, telegraphic communication was sent to the petitioner for stopping the distribution of

gas connections under Deepam Scheme.

This Court at the time of admission, ordered notice to the respondents.

From a perusal of the material placed on record, it is clear that 25,062 LPG connections were allotted to Kadapa District under Deepam Scheme for grounding from November, 2003 to January, 2004. Even from the impugned telegraphic communication, it is not known on what basis it was sent. The petitioner has not questioned any order passed by the second respondent.

In the absence of any interim order passed by this Court and as the petitioner has not questioned any detailed order and in view of expiry of the period for grounding such LPG connections granted under Deepam Scheme in Kadapa District, the petitioner is not entitled to any relief in this Writ Petition at this point of time.

The writ petition is accordingly dismissed. No order as to costs.
