ORDER:

This Civil Revision Petition, under Section 22 of the A.P. Buildings (Lease, Rent and Eviction) Control Act, 1960, is directed against the Judgment dated 08-12-2010, passed in R.A. No.166 of 2010, on the file of the learned Additional Chief Judge, City Small Causes Court, Hyderabad in confirming the order passed in R.C. No.127 of 2007, dated 18-02-2010, by the II Additional Rent Controller, Hyderabad.

Heard the learned counsel for both the parties.

The only request made by the learned counsel for the Revision Petitioner is that the children of the Petitioner have been studying in the locality and if their residence is shifted in the middle of the academic year to any other far off place, it may cause inconvenience to the children and that it is also very difficult to get a suitable accommodation in that locality in the near future.

The learned counsel for the Respondent submitted that the Petitioner has to pay three months rent and also electricity charges and it will be very difficult to recover the amounts if the Petitioner/tenant vacates the premises without notice to the landlord.

In the above circumstances, the Civil Revision Petition is disposed of with the following directions :

1) On condition of Petitioner/tenant depositing an amount of Rs.10,000/- (Rupees ten thousand only) on or before 5^th day of September, 2011, the Petitioner/tenant shall be permitted to continue in the premises till 31^st March, 2012 and shall hand over the vacant possession of the same on or before 10^th day of April, 2012, and 2) The amount deposited by the Petitioner/tenant shall be adjusted towards the rents to be paid by the Petitioner/tenant subject to the adjustment of electricity bills and water bills etc.,
