THE HON’BLE SRI JUSTICE GOPALA KRISHNA TAMADA
CRIMINAL REVISION CASE No.746 of 2004
JUDGMENT:
This Criminal Revision Case is directed against the order, dated 08.01.2004, passed by the III Metropolitan Magistrate, Visakhapatnam, in D.D.R.No.3849 of 2003, whereby the private complaint filed by the petitioner herein alleging the offences punishable under Sections 418 and 420 IPC against the first respondent herein-accused was dismissed under Section 203 Cr.P.C.
This Revision was admitted by this Court on 20.06.2004 and notice was ordered to be sent to the first respondent herein. Even after a lapse of seven years, the notice sent to first respondent herein-accused is not yet returned served. Even the petitioner did not choose to take any steps to get the notice served on the first respondent herein. Further, from a perusal of the impugned order, this Court is of the view that the Court below recorded cogent reasons for dismissing the said private complaint filed by the petitioner herein, which needs no interference by this Court.
In that view of the matter, this Criminal Revision Case is liable to be dismissed.
In the result, the Criminal Revision Case is dismissed.
