Colony, Mansoorabad. It is alleged that the 2nd respondent/defa complainant, purchased the said site under registered sale de dated 25.02.2008 from Chandika Samba Shiva Raju and that created a forged sale deed in favour of A2 for the same land and the same registered through Chandika Simha Siva Raju 22.09.1999 and that the accused are under the process construction in the said site. Even, as per allegations in the cha sheet, A1 is not the person in whosoever, sale deed was execu for the disputed site. The sale deed was taken by A2 for the dispu site. It is contented that since A1 is working in Income T department, he was unnecessarily implicated in this case with a v to force settlement in the matter; and that proceeding of the ca against A1, is nothing short of abuse of process of law. It is not prosecution case, that A1 forged sale deed in favour of A2 and t the alleged forgery is evidenced by any scientific evidence, with there being any such evidence against A1, by simply alleging that created forged sale deed in favour of A2, is not going to serve purpose. In the circumstances, I am of the opinion that, A1 unnecessarily impleaded in this case and the proceedings aga him are nothing but, misuse of process of law.
