This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.766 of 2007 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad, against petitioner Nos.2 to 4. Heard the learned counsel for the petitioners. None appears for the 2^nd respondent.

On a complaint given by the 2^nd respondent, the police registered F.I.R in Cr.No.79 of 2005 of Central Crime Station for the offence under Section 498-A IPC against her husband-A1, sister-in-law A2, brother A3 and daughter-in-law A4. After due investigation, the police filed charge sheet. The Court has taken cognizance as C.C.No.766 of 2007. It is stated that ever since the registration of FIR, A1 is absconding and petitioner Nos.2 to 4 are regularly attending the Court.

Learned counsel for the petitioners would submit that the allegations made against the petitioners are vague and though petitioner Nos.2 to 4 have been regularly attending the Court, the case is not being disposed of.

A perusal of the complaint and charge sheet disclose that specific allegations have been made against petitioner Nos.2 to 4 also. The truth or otherwise of the said allegations cannot be gone into the present proceedings as the same have to be considered on evidence that may be adduced during the course of trial. It is stated that the trial could not commence as A1 is absconding.

There are no valid or justifiable grounds to quash the proceedings against petitioner Nos.2 to 4 in C.C.No.766 of 2007.

Having regard to the fact that the FIR was registered in the year 2005 and charge sheet was filed in the year 2007, the trial Court is directed to dispose of the case against petitioner Nos.2 to 4 at an early date and split up the case against A1 if necessary.

The criminal petition is disposed of with the above direction.
