THE HON'BLE SRI JUSTICE GOPALA KRISHNA TAMADA CRIMINAL PETITION NO.13036 OF 2010

ORDER:

1 The first respondent herein by name Pisati Swathi who is none other than the wife of the first petitioner herein gave a report basing on which Saroornagar Police registered a case in Cr.No.242 of 2009 for the offences punishable under sections 498-A and 506 of IPC and under section 4 of Dowry Prohibition Act against the petitioners herein and after investigation a charge sheet was filed and the same was numbered as C.C.No.145 of 2010 on the file of the Court of the XIV Metropolitan Magistrate, Cyberabad, Ranga Reddy.

2 During the pendency of the said proceedings, it appears, there was a settlement between the parties and in the light of the said settlement, the wife and husband have decided to get their marriage dissolved by filing an OP for divorce and accordingly they filed an application and the same is numbered as OP No.64 of 2010 before the Family Court, Nalgonda.

3 Today parties are present. When questioned the de facto complainant by name Smt. Swathi admitted that they filed a petition seeking divorce by mutual consent and hence she is not interested in getting the matter prosecuted. She further submitted that she has no objection if the said proceedings against the petitioners are quashed.

4 In the light of the said submissions made by the de facto complainant herself that she is not interested in getting the matter prosecuted, this court is of the opinion that the said proceedings pending against the petitioners can be quashed.

5 Accordingly, this petition is allowed and the proceedings in C.C.No.145 of 2010 on the file of the Court of the XIV Metropolitan Magistrate, Cyberabad, Ranga Reddy pending against the petitioners are hereby quashed.
