THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12727 of 2011
ORDER:
Petitioners-Accused Nos.1 and 2 approached this Court with a prayer to recall the Non Bailable Warrants issued against the petitioners on 4.11.2009 passed in C.C. No. 382 of 2008 on the file of IV Additional Chief Metropolitan Magistrate, Hyderabad, registered for the offence under Sections 448 and 506 IPC.
Heard.
The learned counsel for the petitioners- submits that Non Bailable Warrants issued against the petitioners are pending before the lower Court. The learned counsel for the petitioners further submits that the said Non Bailable Warrants may be recalled.
Considering the submission of the learned counsel for the petitioners and also in view of the facts and circumstances of the case, the petitioners-Accused Nos. 1 and 2 are directed to file application before the lower Court for recall of Non Bailable Warrants. On filing such application, the lower Court is directed to recall the Non Bailable Warrants issued against the petitioners-accused Nos. 1 and 2 on the same day.
With the above observations, the Criminal Petition is disposed of. Miscellaneous petitions filed in this criminal petition, if any, shall stand closed.
