JUDGMENT :
This Criminal Appeal is filed by the defacto complainant against the judgment dated 23-09-2010 passed by the XVI Additional Judge-cum-XX-Additional Chief Metropolitan Magistrate, Hyderabad, acquitting the first respondent-accused for the offence under section 138 of the Negotiable Instruments Act.
2. When the matter is listed today, Sri A.K. Kishore Reddy, the learned counsel appearing for the appellant-complainant submitted that the appellant and the respondent No.1 had compromised the matter out of court and a memorandum of understanding was also executed to that effect. Therefore, on the instructions of the appellant, the learned counsel seeks to withdraw the criminal appeal, as the appellant is not interested to prosecute the matter, as it is settled out of court.
3. Recording the above submission, the criminal appeal is
dismissed as withdrawn.
