ORDER:-
This is an application filed under Section 462 of the Companies Act, 1956 read with Rules 306 and 298 of the Companies (Court) Rules, 1959 by the Official Liquidator attached to this Court acting as Liquidator of M/s.Ramakrishna Equity Funds Limited (in Liqn) seeking to condone the delay of 189 days in filing the half yearly accounts along with Audit Report for the period from 1-4-2009 to 30-9-2009 of the above named Company (in Liqn); to take the half yearly accounts on record and permit the Official Liquidator to pay the balance audit fee to the auditors. Along with the application, the Auditor’s Report, dated 15-9-2010 submitted by Padmanabha Rao & Co., Chartered Accountants, the affidavit of the Official Liquidator verifying the account and the statement of account are also enclosed.
On perusing the documents placed on record and affidavit filed in support of the application, delay of 189 days in filing the half yearly accounts is condoned and the half yearly accounts submitted in respect of M/s.Rama Krishna Equity Fund Limited (in Liqn) is hereby approved. The Official Liquidator is permitted to pay the balance audit fee to the Auditors.
Accordingly, the Company Application is allowed. No order as to costs.
