JUDGMENT:
This Contempt Case is filed by the petitioner seeking to summon the respondent personally and punish him for his willful, intentional and deliberate violation of the order dated 6.11.2008 in W.P.M.P.No.30352 of 2008 in W.P.No.23293 of 2008 passed by this Court under the provisions of Sections 10 to 12 of the Contempt of Courts Act.
Petitioner herein is the writ petitioner and respondent herein is the 2nd respondent in W.P.No.23293 of 2008.
Originally, the petitioner filed W.P.No.23293 of 2008 seeking to declare the action of the respondent herein and 2nd respondent therein in issuing the notification in Lr.No.HRD/HR3/Back log vacancies/2314/2008, dated 4.10.2008, as illegal, arbitrary and against Articles 14,16 and 21 of the
Constitution of India besides being opposed to regulation Nos.9,11,12 and 24 of the Federation and against General Rule 22 of A.P. State and Subordinate Service Rules and quash the same and consequently, direct the respondent herein and 2nd respondent therein to consider the case of the petitioner for promotion to the post of Area Officer as per his seniority and eligibility as per regulation No.11 (b) of the Federation.
Along with this writ petition, the petitioner also filed W.P.M.P.No.30352 of 2008 seeking to suspend the notification in Lr.No.HRD/HR3/Back log vacancies/2314/2008, dated 4-10-2008 of the respondent herein and 2nd respondent therein and consequently direct the respondent herein and 2nd respondent and another therein to consider the case of the petitioner for promotion to the post of Areas Officer as per his seniority and eligibility as per regulations No.11 (b) of the federation, pending W.P.No.23293 of 2008 on the file of the High Court.
In the said W.P.M.P., this Court by order dated 6.11.2008, granted interim direction to the respondent herein and 2nd respondent and another therein to consider the case of the petitioner for promotion to the post of Areas Officer as per the regulations in any existing vacancy, and pass appropriate orders within a period of four weeks from the date of receipt of a copy of that order and communicate the same to the petitioner.
Complaining the non-compliance of the said order, the petitioner filed the present Contempt Case.
When the matter is taken up for hearing, the learned counsel for the petitioner has submitted that the orders dated 6.11.2008 passed by this Court in W.P.M.P.No.30352 of 2008 in W.P.No.23293 of 2008 have been complied with and hence, the Contempt Case may be closed.
Recording the above said submission, this Contempt Case
is closed. No costs.
