Apprehending action by the respondent Nos. 1 and 2 to issue temporary permits to the 5th respondent on the basis of the recommendations by the 4th respondent contained in the letter dated 20-05-2009 for quarrying of sand in survey No. 253 of Padira village, Yellareddypet Mandal, Karimnagar District and assailing the same as contrary to the procedure contemplated under the Andhra Pradesh Minor Mineral Concession Rules, 1966 and the Andhra Pradesh Water, Land and Trees Act, 2002, this writ petition is filed in the ‘public interest’.
It is stated by the learned Government Pleader for Industries and Commerce, on instructions from the respondent Nos. 1 to 4 that no permission or lease has been granted to the 5th
respondent on the basis of the recommendations by the 4th respondent contained in the letter dated 20-05-2009 addressed to the 2nd respondent. In the letter dated 20-05-2009 the 4th respondent had recommended accord of temporary permission for removal of sand in an extent of Ac.06-06 guntas in survey No. 253 of Padira village, which are private lands and for which the pattedars are stated to have issued consent letters for lifting of sand from their patta lands for a period of one year in favour of the 5th respondent.
In view of this averment on behalf of the respondent Nos. 1 to 4 by the learned Government Pleader the substantive grievance asserted in this writ petition does not survive for consideration. The writ petition is accordingly dismissed as ‘infructuous’. No costs.
