ORDER:-
This writ petition is filed for a Mandamus to declare the inaction of respondent No.2 in completing the investigation and filing the charge sheet in FIR.No.282, dated 21.10.2008, as illegal and arbitrary. At the hearing, there is no representation for the petitioner and respondent No.3.
The learned Assistant Government Pleader for Home, on instructions, submitted that in the month of August 2009, respondent No.2 filed charge sheet after completion of the investigation and the XIII Additional Chief Metropolitan Magistrate, Nampally, took cognizance of the case as C.C.No.1897 of 2009.
In view of the submission of the learned Assistant Government Pleader, the cause in the writ petition does not survive for consideration and the writ petition is accordingly dismissed as infructuous.
As a sequel to dismissal of the writ petition as infructuous, WPMP.No.11848 of 2009 filed by the petitioner for interim relief is also dismissed.
